KitaJagaKita provides structured administrative pathways for registered members and platform users. It is not a court, credit-reporting agency, law firm or enforcement authority. Registration, submission or publication does not guarantee approval, recovery, payment, verification, employment, contract award or any other result.
1. Acceptance of These Terms
By accessing, registering for, submitting information to or using KitaJagaKita, you agree to these Terms of Use, the Privacy Notice, the Security Notice and any additional conditions presented for a specific service.
When using KitaJagaKita on behalf of a company, organisation, employer, association or another person, you confirm that you have authority to accept these Terms and submit the relevant information on their behalf.
2. Platform Operator
KitaJagaKita is operated by the Malaysian Sub-Contractors Association (“MSCA”). References to “KitaJagaKita”, “MSCA”, “we”, “us” or “our” in these Terms refer to the platform operator and authorised personnel supporting the relevant service.
KitaJagaKita is described as Malaysia’s Business Protection Portal. This description explains the platform’s intended administrative and community-support function and does not imply governmental, regulatory, judicial or enforcement authority.
3. Definitions
- Account
- A portal account created or activated for an approved user to access available member or case functions.
- Applicant
- A person who submits a FREE membership registration or requests account access.
- Member
- A person whose KitaJagaKita membership registration has been accepted or activated. KitaJagaKita membership is separate from MSCA association membership.
- Concern
- A factual matter submitted for structured administrative intake, review, response or support through the platform.
- Named Party
- A person, company or organisation identified in a concern or related submission.
- Platform Services
- The website, forms, registration pathways, case tracking, member-facing functions, opportunities and related support made available from time to time.
4. Eligibility and Authority
To use a service, you must have legal capacity to do so, provide accurate information and hold any authority required to act for another person or organisation.
We may request clarification or supporting information where reasonably necessary to confirm identity, authority, eligibility, relevance or the integrity of a submission.
We may refuse an application or submission where the information is incomplete, outside the platform’s scope, inconsistent, abusive, unlawful or reasonably suspected to be fraudulent or malicious.
5. FREE KitaJagaKita Membership
KitaJagaKita may offer FREE membership registration. FREE refers to the registration or membership fee stated for the relevant campaign and does not mean that every current or future platform service must be provided without charge.
- benefits are available only to registered and activated members;
- benefits may depend on eligibility, service availability and additional service-specific terms;
- an application is not automatically approved or activated;
- registration does not automatically create MSCA association membership;
- MSCA membership applications must use the official MSCA registration pathway; and
- we may revise, add, limit or discontinue member benefits where reasonably necessary.
6. Accounts, Login Credentials and Security
You are responsible for keeping your login credentials confidential and for activity performed through your account, except where activity results from a security failure for which you are not responsible.
- use a strong and unique password;
- do not share passwords, one-time passwords or login links;
- do not send passwords or banking credentials through WhatsApp;
- promptly report suspected unauthorised access or account misuse;
- keep your registered email address and mobile number current; and
- sign out when using a shared or public device.
We may require password reset, account verification or temporary access restriction where reasonably necessary to protect the account, users or platform.
7. Platform Services and Availability
Available services may include FREE membership registration, member login, concern submission, case references, case-status access, administrative communication, opportunities and other member-facing services.
Services may be introduced, tested, changed, paused, restricted or withdrawn. A page, button or description does not guarantee that a service is continuously available or available to every user.
We may use third-party hosting, communications, authentication, storage or support providers to operate the platform.
8. Concerns, Documents and Other Submissions
You must provide information that is accurate to the best of your knowledge, relevant to the stated purpose and presented in a fair and non-misleading manner.
You must not submit:
- false, fabricated, altered or materially misleading content;
- documents or personal information you are not authorised to provide;
- unnecessary identity documents or excessive personal data;
- malware, harmful files or content intended to disrupt systems;
- threats, discriminatory abuse or unlawful harassment;
- content intended primarily to shame, retaliate against or unlawfully pressure another party; or
- information that violates confidentiality, court orders, contractual obligations or applicable law.
You remain responsible for retaining your original documents and independent records. Submission to KitaJagaKita is not a substitute for preserving evidence or meeting legal, contractual or statutory deadlines.
9. Fair Process and Named-Party Responses
Receipt of a concern does not establish wrongdoing, liability, debt, misconduct or any legal finding.
Where appropriate and reasonably practicable, a Named Party may be informed of relevant allegations and invited to provide a response, correction, explanation or supporting records.
We may redact personal data, confidential information, contact details or material that is not necessary for the response process. We may also withhold information where disclosure could create a safety, legal, confidentiality or integrity risk.
10. Privacy and Confidentiality
Personal data is handled as described in the Privacy Notice. Security practices and user-security responsibilities are described in the Security Notice.
KitaJagaKita does not automatically publish every concern, document, response or identity submitted to the platform. Information may be used or disclosed where reasonably necessary to administer the matter, communicate with relevant parties, operate the service, obtain professional support, protect rights or comply with legal obligations.
Users must treat case information, responses and documents received through restricted account access as confidential unless disclosure is authorised, legally required or reasonably necessary to obtain professional advice.
11. Prohibited Use
You must not:
- impersonate another person or misrepresent your authority;
- attempt unauthorised access to accounts, records, systems or restricted areas;
- scrape, harvest, copy or systematically extract platform data without written permission;
- interfere with platform operation, security controls or another user’s access;
- use automated tools to overload, probe or abuse the platform;
- use case references or account details belonging to another user without authority;
- use platform information for unlawful blacklisting, discrimination, intimidation or defamation; or
- present a KitaJagaKita administrative status as a court ruling, official government record or guaranteed commercial assessment.
12. Case Handling, Support and Outcomes
Depending on the circumstances, a matter may undergo administrative intake, clarification, document collection, response from a Named Party, assessment, referral, attempted resolution or closure.
KitaJagaKita does not guarantee:
- acceptance of a concern or membership application;
- a response from another party;
- recovery of money, property or documents;
- settlement, mediation, enforcement or legal action;
- verification of every statement or document;
- a decision within a fixed period unless expressly confirmed;
- future conduct, solvency or performance of any person; or
- any particular assessment, recommendation or outcome.
Users should obtain independent legal, financial, technical or other professional advice where the matter requires it.
13. Opportunities, Listings and Third Parties
Opportunity listings may include project work, subcontract packages, supplier requirements, vendor requests or professional vacancies. Publication does not constitute endorsement or a guarantee of accuracy, payment, award, employment or performance.
Posting and responding parties are responsible for their own due diligence, eligibility checks, quotations, negotiations, contracts, insurance, licences, tax obligations and professional advice.
Third-party websites, WhatsApp, payment services, authentication providers or external forms are governed by their own terms and privacy practices. KitaJagaKita is not responsible for third-party services outside its reasonable control.
14. Fees and Payment
FREE membership registration does not mean every platform service is free. A service may be free, member-supported, sponsored or chargeable.
Where fees apply, the relevant scope, price, payment terms and refund or cancellation conditions should be communicated before the chargeable service proceeds.
Do not send payment solely because a person claims to represent KitaJagaKita. Verify payment instructions through an official published contact before transferring funds.
15. Email, WhatsApp and Electronic Communications
By providing contact details, you agree that we may contact you regarding registration, account activation, cases, requests for clarification, platform administration, relevant member services and security matters.
WhatsApp registration requires the applicant to review and send the prepared message. A website cannot silently send a WhatsApp message on the user’s behalf.
You are responsible for checking that the destination number, email address and message are correct before sending. Do not include passwords, one-time passwords, bank credentials or unnecessary sensitive information in WhatsApp messages.
16. Intellectual Property
KitaJagaKita branding, website content, layouts, graphics, databases, software and materials owned by or licensed to MSCA are protected by applicable intellectual-property laws.
You may use the platform for its intended personal or business purpose. You may not reproduce, sell, license, republish, modify or commercially exploit protected platform materials without written permission, except where permitted by law.
You retain ownership of content you lawfully submit. You grant us a limited permission to host, store, review, reproduce, redact, communicate and otherwise process that content as reasonably necessary to provide the requested service, administer the platform, protect rights and comply with legal obligations.
17. Refusal, Restriction, Suspension and Termination
We may refuse, restrict, suspend or terminate access, membership, listings or submissions where reasonably necessary for:
- security or account protection;
- suspected fraud, impersonation or misuse;
- false or materially misleading information;
- harassment, threats or abusive conduct;
- non-compliance with these Terms;
- legal, regulatory or contractual obligations;
- unpaid applicable fees; or
- service maintenance, discontinuation or operational needs.
Where appropriate, we may request corrective action or provide a reasonable opportunity to explain before final restriction. Immediate action may be taken where delay could create security, legal, safety or integrity risks.
18. Disclaimers
Platform content and services are provided within their stated administrative scope and on an “as available” basis, subject to applicable law.
Nothing on KitaJagaKita automatically constitutes legal advice, financial advice, a credit rating, a court finding, a government record, professional certification or a guarantee of another party’s identity, conduct, capacity or performance.
Users must independently assess decisions involving contracts, payments, employment, property, supply, investment, legal rights or other material risks.
19. Limitation of Liability
To the extent permitted by applicable law, MSCA and KitaJagaKita will not be liable for indirect, incidental, consequential, special or punitive loss arising from:
- reliance outside the stated scope of a platform service;
- actions or omissions of users, Named Parties or third parties;
- loss of opportunity, profit, goodwill or business data;
- unauthorised account use caused by the user’s failure to secure credentials;
- third-party websites, communications or service providers; or
- events beyond reasonable operational control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any mandatory rights available under applicable law.
20. Changes to These Terms
We may update these Terms to reflect changes in services, membership benefits, security practices, operational requirements or applicable law.
The updated version will be published with a revised effective date. Material changes may also be communicated through the website, registered email, account notice or another appropriate channel.
Continued use after an updated version takes effect constitutes acceptance of the revised Terms, subject to applicable law.
21. Governing Law and Disputes
These Terms are governed by the laws of Malaysia. The parties should first attempt in good faith to resolve a dispute relating to the platform through written communication with the operator.
Where a dispute cannot be resolved informally, it may be referred to the courts or another competent process in Malaysia, subject to any mandatory rights and jurisdictional requirements.
